Houston Work-Related Motor Vehicle Accident Attorney
If you were injured in a motor vehicle crash while driving for your job in Houston, you may recover far more than workers’ comp through a third-party or non-subscriber claim. The Moudgil Law Firm identifies every liable party — your employer, the at-fault driver, and others — to pursue your full compensation.
Free Consultation | No Fee Unless We Win | Available 24/7
Motor vehicle crashes are the single leading cause of work-related deaths in the United States, and Houston’s sprawling highways, heavy commercial traffic, and energy-sector logistics make on-the-job driving especially dangerous here. Delivery drivers, sales reps, oilfield and construction crews, healthcare workers, and anyone who drives as part of their duties faces serious risk every shift. When a crash happens on the clock, The Moudgil Law Firm helps injured workers recover the compensation a standard comp claim will never fully provide.
Our Houston workplace injury attorneys handle the full range of workplace injury types, and work-related vehicle crashes are among the most valuable because they so often involve a third party. That extra layer of liability is exactly what unlocks recoveries far larger than workers’ compensation alone.
What Counts as a Work-Related Motor Vehicle Accident?
A work-related motor vehicle accident is any crash that happens while you’re driving in the course and scope of your job — making deliveries, traveling between job sites, transporting equipment, or running work errands. It does not include your ordinary commute to and from work, though there are important exceptions for travel that benefits your employer.
The “course and scope” question is often where insurers fight hardest, because it determines whether your injury is covered at all. According to the National Institute for Occupational Safety and Health (NIOSH), crashes affect workers in every industry — whether they drive a tractor-trailer or a passenger car, and whether driving is their main duty or only an occasional one. The Occupational Safety and Health Administration (OSHA) also makes clear that employers have a duty to protect workers who drive on the job.

- Sales and service representatives — driving a territory in personal or company vehicles

Your Legal Options After an On-the-Job Crash in Texas
In Texas, an injured worker generally has three paths after a work crash: workers’ comp from a subscribing employer, a lawsuit against a non-subscriber employer with no comp coverage, or — most importantly — a third-party claim against the at-fault driver or company. A third-party claim can be pursued even while you receive comp benefits.
Texas is the only state that does not require private employers to carry workers’ compensation insurance, so many are “non-subscribers.” The Texas Department of Insurance explains injured workers’ rights under the comp system, but comp benefits are capped and pay nothing for pain and suffering. A personal injury claim against the negligent party recovers the full value of your losses.
- Workers’ compensation — from a subscribing employer; limited medical and wage benefits, but bars you from suing that employer
- Non-subscriber lawsuit — against an employer without comp coverage; recovers full medical costs, lost wages, and pain and suffering
- Third-party claim — against the at-fault driver, another company, a vehicle or parts manufacturer, or a negligent contractor whose carelessness caused the crash, pursued in addition to any comp benefits
When a crash is fatal, surviving family members may bring a wrongful death claim — including, in cases of gross negligence, against an employer who carries workers’ comp.
Why Third-Party Claims Matter So Much
The biggest difference between an ordinary work injury and a work-related crash is the third party. When someone other than your employer caused the wreck, you can sue them directly for your full damages — pain and suffering included — while still collecting workers’ comp. That combination often produces a recovery many times larger than comp alone.
Identifying every liable party early is critical, and crashes involving commercial vehicles frequently have several. Commercial drivers and carriers are bound by federal safety rules enforced by the Federal Motor Carrier Safety Administration (FMCSA), and violations of hours-of-service, maintenance, or loading rules can establish negligence. Potentially liable parties include:
- The at-fault driver who hit you
- That driver’s employer (under vehicle-for-work liability rules)
- A trucking company or carrier that violated safety regulations
- A vehicle or parts manufacturer if a defect contributed to the crash
- A contractor or property owner responsible for hazardous road or site conditions

Compensation You Can Recover
Through a third-party or non-subscriber claim, you can recover the full range of damages the law allows — not the fraction workers’ comp pays. That includes all medical expenses, lost income and earning capacity, and non-economic harm such as pain, suffering, and diminished quality of life.
Economic Damages
- Medical expenses — emergency care, surgery, rehabilitation, and future treatment
- Lost wages — past and future income, plus diminished earning capacity
- Out-of-pocket costs — vehicle damage, medical equipment, travel, and home modifications
Non-Economic Damages
- Pain and suffering from the crash and your recovery
- Mental anguish — anxiety, depression, and PTSD after a serious collision
- Physical impairment and disfigurement, and loss of enjoyment of life
For an overview of how crash damages are valued generally, see our car accident compensation page. Texas also invests heavily in crash prevention through the Texas Department of Transportation, reflecting how serious and costly roadway injuries remain statewide.

ANSWERS FOR ACCIDENT VICTIMS
Frequently Asked Questions
We keep clients informed at every step, empowering them to make confident, informed decisions about their case.
How long do I have to file a claim after a work-related crash?
The statute of limitations for a personal injury lawsuit in Texas is generally two years from the date of the crash. Separately, you typically must report a work injury to your employer within 30 days. Missing either deadline can jeopardize your case, so act quickly.
What if I was partly at fault for the crash?
Texas follows a modified comparative-negligence rule, meaning you can still recover as long as you were not more than 50% at fault, though your recovery is reduced by your share of fault. Insurers often exaggerate a worker’s fault to cut what they pay, so it’s important to have your side of the crash documented and represented.
Can I sue the other driver and still collect workers’ comp?
Yes. A third-party claim against the at-fault driver is separate from your workers’ compensation benefits. You can pursue both, which is why work-related crashes often produce much larger total recoveries than comp alone. Your employer’s comp insurer may seek reimbursement from your third-party recovery, and we work to minimize that.
Is my car accident covered if it happened while I was driving for work?
Often, yes — if the crash occurred in the course and scope of your job, such as making deliveries, traveling between job sites, or running a work errand. Your ordinary commute usually isn’t covered, but exceptions apply when you’re traveling for your employer’s benefit or have no fixed workplace. Because coverage hinges on these details, it’s worth having an attorney review the facts.
